Terms of Service
These terms are an agreement between you and GrowthBase360, operated by Daniel Schembri, Malta (“we”, “us”). By creating an account or using GrowthBase360 at growthbase360.com (the “Service”) you agree to them. If you use the Service for a business, you confirm you can bind that business. Please read our Privacy Policy too.
1. The Service
GrowthBase360 is an online CRM for managing deals, contacts, tasks, booking pages, forms, email campaigns and automations in a shared workspace. We may add, change or remove features. We will give reasonable notice of changes that significantly reduce what a paid plan offers.
2. Accounts and workspaces
- You must give accurate information, be at least 16, and keep your password secure. You are responsible for activity under your account; tell us promptly of any unauthorised use.
- The person who creates a workspace is its owner. Owners and admins decide who joins, with what role, and are responsible for the people they invite and for how the workspace is used.
- Each workspace is private to its members. We will not give anyone outside it access except as described in our Privacy Policy or as the law requires.
3. Your content and your customers’ data
- You keep all rights in the content you put into the Service. You give us permission to store, process and display it only to provide the Service to you.
- You are responsible for your content and for having the right to use any personal data you add (for example consent or another lawful basis to contact your own customers). For that data you are the controller and we are your processor; a data processing agreement is available on request.
- You are responsible for the emails you send, the pages and forms you publish, and for complying with laws such as anti-spam and marketing rules, including unsubscribe obligations.
4. Acceptable use
You must not: break the law or others’ rights; send spam, phishing or unlawful or deceptive messages; upload malware or content you have no right to; try to access another workspace or any data that is not yours; probe, overload or interfere with the Service; reverse engineer it except where the law allows; resell the Service without our written consent; or use it to build a competing product by scraping it. We may suspend access to protect the Service or other users, and will tell you why where we can.
5. Third-party services, including Google
Some features connect to services such as Google (Gmail and Google Calendar). Your use of them is also subject to their terms. When you connect your Google account you authorise us to act as described in our Privacy Policy, and you can withdraw that at any time by disconnecting. We are not responsible for outages or changes of third-party services.
6. Plans, fees and billing
- GrowthBase360 offers a free plan with usage limits and paid plans. Current limits and prices are shown in the app before you buy.
- Paid plans are subscriptions that renew automatically each month until you cancel. Payment is processed by Stripe. Prices are shown excluding or including taxes as stated at checkout; you are responsible for applicable taxes.
- You can cancel at any time under Settings → Plan & billing → Manage billing. Cancellation takes effect at the end of the paid period; you keep paid features until then. Except where the law gives you a right to a refund, payments are not refundable for periods already started.
- If a payment fails we will retry; if it cannot be collected we may move the workspace to the free plan. Going over a plan’s limits never deletes data; it only stops you adding more until you upgrade or remove items.
- We may change prices with at least 30 days’ notice, effective from your next renewal.
7. Availability and support
We work to keep the Service available and secure, but we do not promise it will be uninterrupted or error-free. We may do maintenance, usually announced in the app. Support is provided by email on a reasonable-efforts basis.
8. Your data when you leave
You can export your data and delete your workspace or account at any time. Deletion is described in the Privacy Policy. After a workspace is deleted it cannot be recovered, so export first.
9. Suspension and termination
You may stop using the Service at any time. We may suspend or end your access if you materially break these terms, if required by law, or if your account is a security risk, normally with notice and a chance to fix the problem unless that is not possible. If we end a paid plan other than for your breach, we will refund the unused part of the period.
10. Our rights
The Service, its software, design and the GrowthBase360 name and logo belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these terms. If you send us feedback, we may use it without obligation to you.
11. Disclaimers
To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind beyond those that cannot be excluded. We do not guarantee that it will meet your particular needs or that results (such as sales outcomes) will be achieved. Consumers keep their statutory rights.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, revenue, goodwill or data, and our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and €100. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or intentional wrongdoing.
13. Changes to these terms
We may update these terms. For material changes we will notify you in the app or by email at least 30 days before they apply. If you continue to use the Service after that date you accept them; if you do not agree you can cancel and export your data first.
14. Governing law and disputes
These terms are governed by the laws of Malta. The courts of Malta have non-exclusive jurisdiction. If you are a consumer in the EU, you also keep the protection of the mandatory consumer laws of the country where you live and may bring a claim in its courts. Please contact us first so we can try to resolve any issue informally.
